Please read these Terms of Use ("Terms") carefully before using the AI Watch Identifier mobile application ("App") operated by Mobixoft LLC ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

AI Watch Identifier is an AI-powered mobile application that allows users to:

• Identify watch brands and models by taking or uploading photos.
• Get estimated market values for identified watches.
• Receive AI-based authenticity analysis and confidence scores.
• Build and manage a digital watch collection.
• Access educational content about horology and watch terminology.
• Generate and share watch identification reports.

3. User Accounts

To access certain features, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

4. Subscriptions and Payments

4.1 Free Tier

The App offers a free tier with limited functionality, including up to 3 watch scans per day.

4.2 Premium Subscriptions

Premium features are available through various subscription plans (weekly, monthly, annual, and lifetime). Subscriptions are managed through the Apple App Store.

4.3 Billing

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage and cancel your subscriptions in your Apple ID account settings.

4.4 Refunds

Refunds are handled by Apple according to their refund policies. We do not process refunds directly.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Use the App to infringe upon the intellectual property rights of others.
• Upload malicious content, viruses, or harmful code.
• Use automated systems, bots, or scripts to access the App.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Resell, redistribute, or commercially exploit the App or its content without our prior written consent.
• Use the App's AI analysis as the sole basis for high-value financial transactions.

6. AI-Generated Content Disclaimer

Important: The watch identification, value estimation, and authenticity analysis provided by the App are generated by artificial intelligence and are for informational and entertainment purposes only.

• No Guarantee of Accuracy: AI-generated results may contain errors. We do not guarantee the accuracy, completeness, or reliability of any identification, valuation, or authenticity assessment.
• Not Professional Appraisal: The App's results do not constitute a professional appraisal, authentication certificate, or expert opinion. For significant purchases or sales, always consult a certified watch appraiser or authorized dealer.
• Not Financial Advice: Market value estimates are approximate and should not be relied upon as financial advice for buying, selling, or insuring watches.
• Authenticity Limitations: The authenticity analysis is based on visual pattern recognition and has inherent limitations. It cannot physically examine a watch and may not detect sophisticated counterfeits.

7. Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by Mobixoft LLC and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. User Content

By uploading photos or other content to the App, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze such content solely for the purpose of providing the App's services. You retain ownership of your original content.

9. Third-Party Services

The App integrates with third-party services including:

• Google Generative AI (Gemini): For watch identification and analysis.
• Firebase: For authentication, data storage, and analytics.
• RevenueCat: For subscription management.
• Apple App Store: For distribution and payments.

Your use of these third-party services is subject to their respective terms and privacy policies.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind, either express or implied.
• We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability to you for any claims arising from or related to the App shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not liable for any losses resulting from reliance on the App's AI-generated identification, valuation, or authenticity assessments.

11. Indemnification

You agree to indemnify and hold harmless Mobixoft LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the App or violation of these Terms.

12. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mobixoft LLC regarding the use of the App and supersede all prior agreements and understandings.
